    This if u sent your packet by US postal mail . Fedex and other courier dont deliver to PO boxes . There is another street address for other courier.

    Thanks Milind70 for the reply , yes I did use USPS because the the IO told me to send my 485 package to the address shown on I140 receipt and Fedex does not deliver mail at P.O box. I am wondering if the P.O Box address is right and should i wait for 90 days or call them based on Lockbox receipting update bec as per Aug10th release TSC shows done receipting till June 28th? Is there a way to inquire regarding my application?

    looks like they are now processing jul-aug 2003 cases, i got mine on may 21st, i'm a jul 2nd filer with pd jul 2003.


    I got my Welcome Notice and actual card today (in separate envelopes). Status was updated exactly a week ago - last Tuesday.

    To buttress IV strategy any tasks for members during the holiday season..I understand we dont dicuss any strategies in open Forums..but to support your strategies during the holiday season?..people will have a little more free time..so we can involve in writing / meeting senators!??..

    There is only lill time before the senate opens again!

    Before starting the application process for permanent immigration, foreign nationals who enter the United States on non-immigrant visas (NIV) are considered to be here temporarily. The law presumes NIV holders intend to return to their home countries at the end of their stay in the United States. There are many NIV categories — student visas, business visas, visas for tourism, and investor treaty visas to name a few. While NIV applicants must have the intent to return to their home country, there are a few non-immigrant categories that allow a person to have dual intent, that is, to intend to be here temporarily now but eventually to immigrate. Prior to permanently immigrating to the United States, a foreign national will generally enter on a non-immigrant visa (dual intent NIV).

    All NIV applicants are required to fill out an application form to the appropriate consular post and submit the DS forms according to the NIV category they are applying. The current forms available are DS-156, 157, 158, 156K, 3032). Currently, twelve consular posts are required to use Form DS-160, a Web-based NIV application form that incorporates all of the current NIV forms into one format via the Web site. When an NIV applicant fills out the form, the applicant has the option of uploading a digital photo. Once the form is submitted online, the NIV applicant will receive a confirmation page. The new DS-160 form is required in twelve posts (including Mexican and Canadian posts, Dublin, Hamilton, Hong Kong, and Tripoli), and the DS-160 form advances the NIV process since it is submitted in advance of the interview.

    NIV applicants should make sure to utilize the appropriate DS form according to the consular post requirements currently in place.

    Immigration experts,
    Please help me to get out of this confusion.

    My H4-H1 Adjustment of status is approved and i have Advance parole and EAD with me through my husbands i485 application.I need to travel to india in jan/feb 2008 for 2-3weeks.I may not be able to go for stamping at that time.My H4 visa stamp is valid till sep2008.My H1 approval notice is valid till sep2010.

    My question is,can i travel to india and come back without H1 stamping using Advance parole?If i come in using Advance parole can i work again on H1 or do i need to use EAD?

    It is a good opportunity for state chapters. Unfortunately not many state chapters are yet formed despite having 8000+ members. We have members from every state but only a handful state members are actively working. Unless we all ourselves take responsibility and actively organize and participate in state chapters it is tough to use the grassroots level strength of this organization. We have more than a thousand members coming everyday to this site and posting ideas, opinions and what IV should do and what IV should not do. We all can achieve everything easily if everyone actively makes their state chapters alive and participate. If you feel that there is nobody in your chapter, then take a lead role and organize it. If you find that few members have signed up, and nothing is happening, then PM all those that are signed up and start working on action items.

    The date you sign the form has nothing to do with the date USCIS receives your application packet.

    if we sign 28th june , it will be considered 1st july filing ?

    What happens if there is any future foreign travel planned and COS decision does not come in time. Will she have to wait to home country till decision is heard and then go for H4 stamping or she can anyways go for H4 stamping even if COS decision is pending?

    It is mentioned by many that PD should be current at the time of GC approval. Is that right?
    I know people from India who got their GC approved when their PD is not current.
    One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!

    hi,

    i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
    1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.

    (a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
    if AoS is pending, then its valid till the AoS case is decided?

    (b) If the validity is 1 year, what is the process for extending the I94 validity?

    a. Yes, you are on valid AOS status.
    b. No need to extend your I-94 as long as your AOS is pending.

    MY PD - July 8 2004, RD July 2 2007 NSC. I-485 - Pending USCIS's mistaken with EB Classification. (came to know of this after opening 3 SR's and 3 Infopass appointments).

    My Attorney wrote to USCIS last week about the problem with my I-485 (USCIS mistakenly put me as EB3 instead of EB2). I want to know experience of memebers / Attorneys who have writen to USCIS for any reason(s) (USCIS Mistakes, Eb3->EB2 porting, Etc) and goten response and how long did it take for getting the reponse. Any Hard LUDs/Soft LUD's after sending letter etc.

    Please share you experience.
