You can have the new stamping done before 6 months of expiry of the current stamp in ur passport or within 1 year of it's expiry.

Same thing happen in our case, transfers TSC to local office(FL) for speed processing then after 16 months we got interviews letter from local office to attend the interview.

You are correct that if you do not maintain valid H-1 status your wife will lose legal status in the US. If she pursues a degree as a FULL TIME student she can file for a COS to F-1. As part of that application she will have to document her valid H-4 status by proving that you are in valid H-1 status with current paystubs and/or letter confirming your employment from your H-1 employer. So it would be safest to file the COS while you are still employed.

i just noticed your post. i am from portland, oregon. so count me in also. i had posted a message on the orgon state chapter a while ago and have not had a single response yet. Inspite of the large numbers of members in seattle and portland areas, i too am sad to see to this kind of inactivity and non-response.

The filing location will be the VSC because that's your worksite. The rule requiring you to file in CSC has to do with the "H-1b employer" itself being cap exempt (ie. institutions of higher education and certain non-profit organizations). Your H-1b employer is a for-profit company, I assume, so they are not exempt from the cap.

Complete your profile first. How come your GC is not approved if your PD is Nov'02 with EB-2 India....Is your I-140 approved and I-485 pending for more than 180 days? If so, it doesn't matter if your employer revokes I-140, you will be covered under AC21, provided you have another job offer in a same/similar position.

Yes, If you have enough Money, Usally 8,000-10,000 $ in the bank statement( This is checked for covering any Medical Bills etc when they are here, just to make sure that the sponser is able to take care of all these when they are in US), That would be enough for you to sponser them.

1) Why TSC is late in issuing receipt compared to NSC?
2) Looks like more applicaiton were filed at NSC than at TSC, Why?
3) Why even then TSC is late in issuing reciept?
4) Which one is faster in approving 485, TSC or NSC?
5) Does any body know how many application each service center recieved during the VB fiasco?

I am a registered professional civil engineer in the state of PA having an educational background of a BS from India and MS from the US in civil engineering. I got my H1B extension approved last year for its second term of three years. I have been working in the same company since my graduation and also hold an approved I-140. I am planning to visit India in March to get my visa stamping done and am concerned about the reports of valid H1B holders being returned from Newark. Do you think I should avoid Newark as the PoE?

Hi All,
I transferred my H1B from Company A to Company B. Currently i am working with Company B, but my Company -B's H1B Application is Still in Pending.
Now i would like to do the COS from Company B(pending H1B) to F1 as I already received I-20 from the University for the Spring 2010.
Case Description: Assume that, we applied Change of Status from H1B to F1 and it is in pending status.
Case i : what happens to my Pending H1B Application with the Company B.
Case ii : What happens if my H1B with Company B gets approved/Denied, when COS from H1B to F1 is pending.
Case iii: what happens if my H1B to F1 Change of Status gets denied.
Appreciate your valuable answers.

concurrent filing means filing of I-140 and I-485 together not two I-140s.
why do you want to put false data on your profile? such as EB1 at Perm stage with 2000 priority date?
Are you trying to mock all the IV members? Or just being silly?

P.S.-regarding my profile that's the default setting w.r.t priority date etc when i set up my account., trying to edit this

I ran into similar circumstances in 2008 and i accepted some amount on 1099. So far nothing has happened. At that time money was more important for me than anything else. It was just one instance in my 5 years on H1. Right now i applied for I-140 and waiting for approval. I maintained my H1 status pretty good all the time. If there is ever an enquiry i'm thinking of explaining the proper reason why i accepted the payment on 1099. Hopefully there shouldn't be any problem.
To sum it up, It is illegal to accept payments on 1099 when you are on H1. And i would advice everyone to stay away from 1099. Every case is different and you never know what is going to happen
