H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer. A U.S. employer may petition a foreign national under the H-1B classification which specifically applies to individuals in a “specialty occupation." A specialty occupation has three requirements. First, an individual must have a bachelor’s degree or higher degree or its equivalent for the particular position. Second, the degree must be common in the industry among similar organizations. Third, the employer must normally require a degree or equivalent; or the nature of the specific duties is so specialized and complex that knowledge required to perform the duties is usually associated with attainment of the degree.
Individuals with H-1B visas are allowed to work in the United States for up to six years, but visas are granted in three-year increments. In some cases, the H-1B visas may be extended for more than six years. If the individual is in the United States, a change of status to an H-1B is filed in the United States. If the individual is outside the United States, upon approval of the petition, the individual must apply for an H-1B visa at the U.S. consulate. There are only 65,000 H-1B visas issued per year.
The beginning of the fiscal year for 2010 is October 1, 2009. Employers may begin filing their petitions six months prior to the start date of employment but the individuals cannot start their jobs until October 1.
It is vital for those individuals wishing to work in the United States to begin preparing their H-1B paperwork before the cap is reached. As of August 7, 2009, approximately 44,900 H-1B cap-subject petitions had been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the cap. Perhaps you may be right. I have not digged that much ....But I will go through that in detail..
Some respectable names in the members list...
I donot think that these people are directly responsible for creating the issue in the first place....It is a reactive response to the anti-immigrant postures of many candidates...Also people like are us are not eligible to donate to immigrantList...Only citizens or premanant residents can contribute to immigrantList.....

TSC is not processing most EB3 I485. This is not supposed to be revealed publicly. It is wrong, so that's why I'm speaking out.
If you are really an undercover USCIS officer, then you can blow the whistle on USCIS illegal (supposed to be) operations...you will have the whistle blower protection offered by the US Govt...

I believe you can change your appointment 2 times ( or probably three times only ). You should be able to change your appointment to Delhi if dates becomes available and you are within the limit of number of changes of appointments allowed.

You can use EAD with current employer. I think your company has to do the change your I9 form to EAD. You don't need to inform as you are not changing any company.

I have been with my employer all along.... and prefer to stay with same employer till GC.
I DONT want to apply for my H1 extension since they are asking lot of questions like Contract details etc with RFE's.
My Q is - Can i use EAD with my EXISTING employer or EAD should be used for only NEW employer based on AC21?
If i use EAD with my current employer, should i have to inform uscis(any process involved)?

I applied for H1B cap exempt physician job on june 25th with my lawyer at vermont service center( wrong center by my lawyer's mistake) and my I-94 Expired on june 30. Vermont center lost or misplaced my file till july 22nd and when we send 2nd file with premium processing they found old file and forwarded it to california center and returned new file back to us. However california center placed recieved date as 22nd july. Later on the center asked for my medical license and that 22days out of status explanation. We send my license which was issued on august 23rd and explained about that 22days out of status. Finally they denied my petition just giving the reason that my license was issued later after my initial petition was filed meaning i was not eligilble for the job when i filed and cannot consider the evidence that came after in existence........now my question is
1-) in final decision they didnot mention anything regarding that 22days out of status issue
however mentioned that i filed on july 22nd.
so when now i go to consulate in india should i mention this 22days as out of status as overstay or still i am in status because i have my fedex reciept of sending my file on june 25th and final decision came on sept 15th. Need expert opinion guys ....thank you...

No, there is no form to fill out. Just write a letter with all the pertinent information (Alien #, etc) to identify your case. Include a copy of the approved I-140 with the letter.

Recently my company got acquired by another company. Co A had filed for my LC, and was approved in Feb 09, and my i140 was filed in EB3 in Sept 09. Co B wants to keep me, and I will continue the same job. My H1 has also been transferred to Co B. My question is:
will there be any effect on my LC and I140? If so, what happens to my PD (Nov 08)

Citizenship and Integration Direct Services Grant Program - The first funding opportunity will focus on providing funding for local programs that are currently working to promote the rights and responsibilities of citizenship through direct citizenship preparation programs for lawful permanent residents. Examples of such programs include those with initiatives to prepare lawful permanent residents for the civics and the English reading, writing and speaking portions of the naturalization test.

One of my minor dependents appears to have been out of status due to non renewal of their H4 visa. We thought that like the original application, dependents were covered by my renewal, found out too late that this is incorrect. Since then we have obtained renewals and the dependent in question now has an approved H-4 status, plus pending 485 and advanced parole.
I have been told though that time out of status is not counted against minors. Is this true?
Is there any risk in travelling out of the country to get visa stamped and returning? I understand this resets the clock. Can the embassy look into the history, find out that previous issue and deny the H-4 stamping because of it?
I am very discouraged by this long drawn out process. Any information would be appreciated.
PS: The minor in question just turned 14 years old. Could this be the reason?

Yes - as long as your 485 is pending and you have a US address to receive the card.
So in this case, the person should send the documents from India, correct? One of the requirement was I-94 card. How will we provide that if you are out of the country? What to say for Last Entry?

If you look at VFS appointment scheduling if it is more than 1 year that your 797 was renewed and if you did not go for stamping they put you under different class of renewal.
You can check this by going to VFS appointment site and there they ask the question are you applying for the same class of visa that got expired 1 yr ago or something like that...
Can anyone shed some light on this. Since i am on the same boat like the person who asked this question.
