Hi,
My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.

I assume you are concerned about your wife's status so you are specifically asking if USCIS would consider July 1st RD. Now if you file again they will not consider the July 1st RD. They will stamp the actual date that they receive. Don't worry about that. Your wife is covered by the H1/H4 extension filing, have you received the receipts for the H extension filings? I assume you would have, it is almost 2 months now. Don't worry your wife's status is all valid.
Stay cool and apply for I-485 for your wife ASAP.

Working with an employer since 2001, EB 3 PD Dec 2003, EAD in 2007, Still on H1b until Nov 10. Though have two masters (both rec'd prior to 2003) i had filed under EB 3 (no one to balim it was just me...was not proactive enough/not enough guidence from the lawyer)
With the same employer, i have rec'd EB 2 approval, want to file I 140 and port EB 3 PD.
Need help/input with folloiwng from the gurus:
1) in EB 3 application the title is "Construction Engineer" with 4 lines of scope of work clarification with bachelors degree in civil engg. and no experience requirement. In EB 2 application, we have used same title "Construction Engineer" with 4 lines of scope of work, we had left 2 lines common (as earlier in EB3 application) and 2 new lines (related to environmental engg. since i have two env. engg. masters with BE in civil engg.)......this ad asked for MS in env. engg. or similar degree with no experience requirement.
Question: EB 2 Labor is approved, i am not sure what they check with i 140 application but does above sound reasonable (not that anything can be changed...but asking for an opinion here).
2) With premium processing, how long it takes to get I140 approved?
3) Do we just file for I 140 for EB 2 first, get it approved and then file letter/application ( i don't know the procedure/protocol) asking to port PD OR do we need file some sort of paper work with I140 to port PD.
4) How long it takes to get case approved (I485) after i140 is approved?

My I-140 is applied during Jan 2007 under EB2 category. My LCA says Masters with 24 months experience amd alternative as Bachelors with 5 Yrs experience. As per the processing time updates, they are processing March 21st 2007. I don't see any updates other than Case is pending.
What should I do to get this processed?. Should I call customer service and ask for SR?

hmmm... i've been trying to export as an eps to freehand or as ai to illustrator, neither of which have been working because i think the file's too big (1200 x 2400). when i export the resulting file appears to be just vertical lines. i'll try just copying and pasting, if it works i will be a happy camper.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

CIS is bound by law to not accept early AOS applications. It depends on State published visa dates. So if we can work with State dept to have them publish the dates for Visa posts for CP as they do today (Which is faster) and add CIS processing delay to the Dates and publish second set of dates for AOS which always be atleast 2 years or more added to current dates published by State.
This gives chance to people, who missed their chance to file in AOS in 2007 July. They can atleast get benefits of AC21 in this tough economy.

My husband has a pending I-130 visa petition (I am a US citizen, he's Italian, we live in Italy). Can anyone tell me whether he is permitted to enter (and exit, as we are still residents in Italy) the US on holiday (departure 19 dec)?

I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?

All, My employer who filed my eb2 application for green card was not giving me labor certification copy and 140 approval notice copy, he is a desi consulting company and as usual with desi company they were giving me tough time to get this documents. (You all know reason.. they think that i will quite). So what i did is requested USCIS to get my I-485 petition copy (remember that if you request 140 or labor copy directly they will not give because it seems that is employer's documents, i discussed this with couple of lawyers as well). since 485 is your application and these documents are mandatory you will get them.
It took about 10 months to get the document with FOIA request (there is a queue as well).
This is what i did
1. Download FOIA form from uscis website.
2. Fill up form and don�t forgot it get notary ( mention to send each and every page of petition).
3. Wait for document...
I will be happy to help anybody who is in same boat.

I filed my 485 on July 5, 2007 at NSC and got my receipt number yesterday. I sent my wifes 485/765/131 on July 24, 2007 to NSC. She is on H4 currently. TOday i got my wifes receipt numbers for all 3. But to my surprise the receipt numbers were given by TSC instead of NSC.
FYI my 140 is pending with NSC.
I am just wondering if this will be a problem? Any one had been through similar situation?
