My friend is filing for student visa(for masters) as her H1B is about to expire in september(already has 6 years on it). She has worked on different projects and even had part-time jobs but she couldnt find a company that can sponsor her H1b. She was also jobless for an year(last)...long story.....anyways.. She lives with her family but her parents cannot help her much cuz their green card application is still in process but she is above 35 yrs old. Now she cannot think of how to answer these questions on F1-Visa.
-Describe the events that led to your decision to study in the U.S.
Describe your intention concerning departure from the U.S.
Show evidence that establishes that you have a residence abroad to which you intend to return
She is from Pakistan and althu she has relatives there and plus her parents own a house(proof of her resident in PK that she can return to) too but you know how the situation is there and she wants to live with her parents. So how should she answer the above questions?

And its official now.. USCIS have consolidated on one more conniving trend to continue to keep us in the dark
The dates are claimed to be "as of " Aug 31st.
When they did this in the last update and said the dates were "as of " July 31 2008, I thought it was going to be a one time thing and in the next update they will give us up to the date info. But hell NO!!
If they only disclose info as of some date in the past, how the hell are we supposed to know whether our case is currently "beyond" normal processing times !!! And how the heck can we file a service request !
They just want us off their back altogether and go at their own pace.
With this staggered (Processing dates and PD) approach, they can manipulate one thing or the other (Spike the PD and retrogress the Proc Date OR vice Versa) and forever juggle and skirt around accountability altogether and don't have to answer or take any status queries at all ! Why don't they use the same intelligence to try to improve their processes and improve their productivity !

Hi,
My attorney filed for H1B extension.
Unfortunately, by mistake LCA stating dates from 07/31/2007 to 07/30/2010.
but I am only qualify upto 06/30/2010 as per 6 year H1B limit.
Atty, told me that 1-129 going to file upto 06/30/2010.
Is it o.k.
I will appreciate your input!
Thank you
You can file an amendment. Mistakes is so common at USCIS.
If you dont want to, I think you can recapture your unused time on h1b and get h1b for extended period based on time not in the US. Check with attorney and see if you can get h1b extension for all the time you were not in US.

H-1B Visa Employer that Does Not Effect a bona fide termination under the H-1B provisions Liable for back wages to H-1B Employee.
To employ H-1B visa nonimmigrants, an employer must fill out a Labor Condition Application (LCA). The LCA stipulates the wage levels that an employer guarantees for the H-1B visa workers pay. In signing and filing an LCA, an employer attests that for the entire period of authorized employment, the required wage rate will be paid to the H-1B nonimmigrant.
An employer need not compensate a nonimmigrant, however, if it has effected a bona fide termination of the employment relationship. To ultimately effectuate a bona fide termination under the INA, an employer must notify USCIS that it has terminated the employment relationship with the H-1B nonimmigrant employee so that USCIS may revoke approval of the H-1B petition. The employer must also provide the employee with payment for transportation home. Failure to do so may subject the employer to liability for back wages to the H-1B employee.
In Amtel Group of Florida v. Yongmahapakorn, Amtel provided notice to the H-1B visa employee that it had terminated the employment relationship. Amtel Group of Florida v. Yongmahapakorn, 04-087 (ARB 9/29/06). However, the court held that notice alone was not sufficient to end the employers obligation to pay the required wages to an H-1B employee. The employer does not effect a bona fide termination and, therefore, end its obligation to pay the required wages to the H-1B employee unless the employer has also notified USCIS. The court therefore ordered Amtel to pay the employee the prevailing wage for an internal auditor until the expiration of her authorized period of stay for H-1B employment, plus prejudgment compound interest on the back pay owed and post judgment interest until the employer made full payment.

Immigration Visa Attorney Blog Has Just Posted the Following:
The attorneys at Fong & Chun, LLP have helped hundreds of legal immigrants seek citizenship over the years. Whether we have worked with you at a naturalization drive, through labor unions, or in our own offices, citizenship is the ultimate goal of most immigrants. Today, the government announced (http://articles.latimes.com/2010/aug/22/local/la-me-refugee-assistance-20100823) that cash assistance to elderly and disabled immigrants who were granted entry based on humanitarian reasons may lose benefits unless they have naturalization applications pending. Many of those affected are people who were granted asylum or refugee status.
Most immigrants are eligible for naturalization after a 3 or 5 year period after their initial residency period begins. Many immigrants delay applying for naturalization because they fear the English or history exams. While the naturalization exam can seem daunting, the government allows for applicants to re-take their exams if they fail the first time. Some immigrants who are long term residents may even take the examination in their native language, but many immigrants simply put off the naturalization process because it has become intimidating or costly. However, in most cases, an immigrant who truly desires to naturalize and is eligible to do so can make an application and be successful with the right type of support and preparation. Today's announcement by the administration poses yet another reason for immigrants who have been putting off their citizenship application to call and find a qualified immigration attorney (http://www.fongandchun.com/lawyer-attorney-1416111.html) to help them with the process. Fong & Chun encourages those eligible for naturalization make an application and realize their dreams of finally becoming US citizens. ---ecf

... and ideally it should be copy of your approved labor.
I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.

Hi,
Last year my husband got laid off. At that time he was on H1 visa, 140 approved and 485 pending. He applied and got AP, and then left U.S in March 2009. AP is valid until March 02, 2010.
Now he wants to get back to U.S. and try his luck finding a job before AP expires.
My question is what are his chances to be able to get in U.S considering
1)He has stayed outside of U.S for about 11 months.
2)He is not employed by any U.S company.
Thanks.
Jijie

Sec. 45. 2 Priority date of applicants.
As it sound to me It means PD of primary applicant will be the PD of spouse and child.
I did not follow.
Anyway this is the situation. I'm in EB3 with a PD Dec 2002. DH is in EB2 with a PD in 2006. Can he file I-485 for us using my PD according to the above law?

My friend lost her green card while she was on vacation in China. She got a temporary green card to travel in a week or so which facilitated her entry into US and once she reached here, she just applied for another green card claiming the initial one as lost. There were no issues except the travel delay and the monetary loss.

With the recent implementation by U.S. Citizenship and Immigration Service (USCIS) allowing concurrent filing of Form I-360 Religious Worker Petition and Form I-485 Adjustment of Status Application, most applicants want to know what documents to submit with an adjustment of status (AOS) application.
Persons with a pending I-360 religious worker petition are now eligible to file an AOS application before September 9, 2009. The AOS application is used by persons who are in the United States to apply with USCIS to adjust to permanent resident status.
Along with the Adjustment of Status Application on Form I-485, one must remember to submit:
a copy of the I-360 receipt notice,
two passport style photos,
a copy of the applicant’s passport,
a copy of the applicant’s birth certificate (along with a certified English translation if the document is not in English), and
a medical examination report performed by a designated civil surgeon.
If an AOS applicant has ever been arrested then a court-certified copy of all arrest records and the final disposition of the case is required (excluding traffic tickets).
Individuals between the ages of 14-79 are also required to submit a Biographic Information Sheet on Form G-325A.
The most important thing to remember before sending the AOS application is the filing fee! Do NOT forget to submit a check or money order to the U.S. Department of Homeland Security in the amount of $1010. No additional fee is required for Form I-765 Employment Authorization Application and for Advance Parole on Form I-131 if filing with an AOS application.
Call us at 214-999-9999 and we will be happy to answer your questions.
