My H1B visa end date is 30July2013(PED or expiration date in H1B visa stamp) and my I-94 end date is 10-Aug2013.But in I797B the end date is 30July2011. Can you please help me that i need to do my H1B visa extension within 30July2011?....please clarrify that visa validity depends on I94 or Visa end date or I797B end date....thanks

Your priority date is not yet current. It will be in August.

Also you need to prove that you have exhausted all ways to get it adjudicated.

tanyas_21: Amendment processing time is same as normal H1 processing time. Your status is H4 until the H1B amendment (797 w/ I-94) is approved or You re-enter USA after you get your H1B stamped. USCIS usually sends cable to home consulate mentioned in I-129 about the approval of H1B - It is one of the reason, most of the attorneys' recommend people to get it stamped from home consulate. As long as you go with all the paper work, You can get it stamped from Mexico, and I dont see any issues. Do not attempt to get it stamped from Canada unless you have a verifiable US education. I have these below queries on Green card processing

My Green card processing background
My labor and I140 are approved and have priority date of May 2006 under EB3 category.

The reason for these questions is that I am planning to change the company that I am working with.

Questions.
1. Can I port the priority date (March 2006) when applying for new green card with new employer.
2. If possible to port the priority date can I apply under EB2 category assuming all other criteria satisfy for EB2 category and use the same (May 2006) priority date.

Photoshop might have a filter that could do this, although I'm not sure off the top of my head. I'd go with the Flash version myself, it's quick, easy and you can cut and paste the result into another package without any hassle.

Standard Test include:

1. Blood test
2. TB skin test ( if this is +ve , then X-rays are done).
3. Immunization : Tetanus, MMR and vericela ( chickenPox)
If you donot have record, you can get these shots again.
If you remember ( or confirm with parents) that u had chickenpox in past , then they can confirm this by bloodtest and u will not need shot.

Dear Core Team,

Can you please indicate on the site if there are any bills (pending or otherwise in both the house and senate) that can get renewed focus or revived that would offer some sort of relief to the current situation of unavailability of visa numbers in the employment based green card process. I strongly feel that the current momentum and attention being drawn by the DOS/CIS update can be used to urge congress to pass some interim measure outside of CIR. That is where in my opinion should IV's focus be at this juncture. If and when you post anything on the site, i and other IV members i'm sure shall begin calling house reps. and senators to urge them for bringing the bill to the floor so that it provides relief to hundreds of thousands of legal immigrants.

I think most the news that H1B's are turned back @POE are not ture. My wife just got her second H1B stamped at kolkotta embassy ( end of jan) and we came back through JFK on Feb 14th. I am on my second H1B. Not a single question was asked. Again Not a single question was asked for first time. Before they used to ask the name of the employer or ur position. We both are permanent employees for a big company ( think of iPhone) and done our MS here. based on my recent experience I do not see any problem with you.

Hi all,

I think my scenario is little complicated.I have my I140 (EB3) cleared with previous employer and my current company has filed new labor and I140 (EB2). They are trying to capture the priority date of my old I140 approval (August 2006).

While my current I140 is still going on, can I apply for I1-485 due to sudden improvement shown for EB2 category in September Visa bulletin.

Please advice.

Employer cannot withdraw your I-485 without your consent and signature, notwithstanding G-28 form.

For the counselor, visiting a son is a more important need than visiting a brother.

Never give childcare as a reason. INS treats this as employment for parents. But religious ceremony for child may work. For medical stuff, I'd say that you need to show that either they cant travel or they are under some treatment here. For both the reasons, you need a US doc to write a letter. The best reasons are travelling to different places in the US.

Me and spouse got the "Card production ordered" and "Welcome notice" emails today morning.

Here is the journey:

Nov.2002 - RIR Labor filed in CA
June 2006 - Labor approved from Phily BEC
July 2006 - I-485 , I-140 filed at TSC
Sept.2006 - I-140 approved
Got stuck in namecheck ( name check may be still pending )
May 20, 2008 - RFE received for missing TB Skin test ( doctor screwed up)
June 4, 2008 - Responded to RFE
June 16, 2008 - Green card approved
Now, waiting for the actual card to arrive.
