I think mom's in the forum can answer this better since i am sure many of them took short term disablity during delivery and subsequent months. My wife took it twice for the birth of our children and I dont think it is an issue.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. You are right - that part of the tutorial is completely broken, and I need to modify it a bit. I am not 100% of the changes you need to make yet, but I will post an example shortly with the changes :)

My I-485 was filed in month of August 2008 under EB2 .I was laid off from my I-485 sponsoring employer(A) in month of August 09 and i took another Job with employer (B) in same field in month of Sep 09. I did not file AC21 as my previous employer's(A) attorney advised not necessary to file AC21.Now I am getting new offer from another employer(C) in same position but this new employer(C) wants me to file AC21 .
What are my options now? Should i file AC21 for employer (B) first and then file AC21 for employer (C) or should i directly file AC21 for employer (C).
I will greatly appreciate your reply.

hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

yes, your employer can file for a new H1B, but you will have to leave the country and get a visa to work on the H1B. An easier process would be for your new employer to take over the sponsorship of your GC by using AC-21.

People who get labor approved in August, can they avail current window provided by USCIS and concurrently file 140/485?

Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...
Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.
Eventually my company received the Labor papers on May 7th 07....
Hope this story helps.

I am in a complicated situation...
Approved labor (PD 2003 EB2) from company A (not employed with them). Filed 140 and 485 (self as primary and wife as dependent). Ability to pay RFE on 140 and then denial on 140 and 485. Currently, appealed the decision because needed to get H1 extension and case has reopened. My wife (with company B) had her 140 approved (EB3 with PD 2006) and so after the July bulletin filed for 485 (her as primary and me as dependent) because my case seeemed a little dicy.
So we both have multiple 485's filed (although the first one since the decision is not final on 140 technically they might not have started considering the 485). Read multiple places that legally you can have only one 485 approved but could have multiple 485 pending and withdraw the other once anyone has been approved. Is this true? or you CANNOT even have two 485 pending?What is the best thing for me do do right now?

I am having my EAD and AP and I am not using my EAD.
EAD expires Sept 08
AP expires Oct 08
My question is
Can I renew AP only ?
If, I do not renew EAD will it be a problem in the future ?
Can I renew it after EAD has expired ?
Also, If I am renewing AP only, when does the 120 days rule come into picture.
Is it with the AP date or EAD date.
